The Payment of Gratuity Act, 1972
Gratuity is a statutory retirement benefit paid to employees in India. It applies to all factories, mines, oilfields, plantations, ports, railways, shops, and establishments that employ 10 or more people on any day of the preceding 12 months. Once an establishment comes under the purview of this Act, it remains covered even if the employee strength falls below 10.
Gratuity Calculation Formula
The gratuity calculation is standardized as follows:
**Gratuity = ( 15 × Last Drawn Salary × Years of Service ) / 26**
Where:
- **Last Drawn Salary**: Basic Salary + Dearness Allowance (DA)
- **Years of Service**: Total years of continuous employment. A fraction of service exceeding 6 months is rounded up to a full year (e.g. 5 years and 7 months is counted as 6 years).
